Please read these terms carefully before joining the QuickMarkr Agent Partnership Program
Important Notice
By applying to become a QuickMarkr agent, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Agent Partnership Program Overview
The QuickMarkr Agent Partnership Program ("Program") allows qualified individuals and businesses to earn commissions by promoting QuickMarkr services and acquiring clients. As an agent, you will have access to specialized tools and resources to help grow your business while helping clients create effective QR code and NFC campaigns.
2. Eligibility Requirements
2.1 Agent Qualifications
To become a QuickMarkr agent, you must:
- Be at least 18 years old or the age of majority in your jurisdiction
- Have a valid business license (if applicable in your region)
- Provide accurate and complete registration information
- Have experience in digital marketing, sales, or related fields
- Demonstrate understanding of QR code and NFC technology applications
- Pass our agent verification process
2.2 Verification Process
All agent applications are subject to verification, which may include:
- Identity verification through government-issued ID
- Business license verification (where applicable)
- Background checks as permitted by law
- Review of professional references
- Assessment of technical competency
3. Agent Rights and Responsibilities
3.1 Agent Rights
As an approved agent, you have the right to:
- Access the QuickMarkr agent portal and tools
- Create campaigns on behalf of your approved clients
- Earn commissions on qualifying client transactions
- Receive marketing materials and training resources
- Request technical support for client-related issues
- Terminate your agent relationship with 30 days' notice
3.2 Agent Responsibilities
As an agent, you must:
- Maintain accurate and up-to-date account information
- Represent QuickMarkr professionally and ethically
- Comply with all applicable laws and regulations
- Provide honest and accurate information to clients
- Maintain confidentiality of client information
- Use QuickMarkr services only for legitimate business purposes
- Report any security issues or suspected fraud immediately
4. Commission Structure
4.1 Commission Rates
Commission rates are determined based on:
- Agent performance tier
- Client subscription level
- Volume of business generated
- Length of client relationship
Standard Commission Structure
- Basic Plan Subscriptions: 15% recurring commission
- Pro Plan Subscriptions: 18% recurring commission
- Enterprise Plans: 20% recurring commission
- Campaign Creation Fees: 10% commission
- Premium Add-ons: 12% commission
4.2 Commission Payment
Commissions are processed according to the following schedule:
- Monthly payment cycle for amounts over ₹10,000
- Quarterly payment for amounts under ₹10,000
- 30-day holding period for new commissions
- Payment via bank transfer, PayPal, or approved methods
5. Client Relationship Management
5.1 Client Assignment
Clients are assigned to agents through our controlled process. Once assigned, you maintain exclusive rights to that client relationship unless terminated or transferred according to these terms.
5.2 Client Data Protection
You must:
- Protect client data according to applicable privacy laws
- Use client information only for authorized QuickMarkr services
- Never share client data with unauthorized parties
- Report any data breaches immediately
6. Marketing and Brand Guidelines
6.1 Approved Marketing Materials
Agents must use only approved marketing materials provided by QuickMarkr. Custom materials require prior written approval.
6.2 Brand Representation
When representing QuickMarkr, you must:
- Use official logos and branding correctly
- Make truthful claims about services and capabilities
- Avoid misleading or exaggerated statements
- Comply with advertising standards and regulations
7. Prohibited Activities
Strictly Prohibited
The following activities will result in immediate termination:
- Creating fake or misleading campaigns
- Sharing account credentials with unauthorized parties
- Attempting to manipulate commission calculations
- Violating client confidentiality agreements
- Engaging in fraudulent or illegal activities
- Spamming or unsolicited marketing
- Competing directly with QuickMarkr services
8. Performance Standards
8.1 Minimum Performance Requirements
Agents must maintain:
- At least one active client every 90 days
- Minimum ₹50,000 in quarterly commission generation
- 95% client satisfaction rating
- Compliance with all training requirements
8.2 Performance Reviews
Agent performance is reviewed quarterly. Agents not meeting minimum standards will receive a 30-day improvement period before potential termination.
9. Termination
9.1 Voluntary Termination
Either party may terminate the agent relationship with 30 days' written notice. You will receive commissions earned through the termination date.
9.2 Immediate Termination
QuickMarkr may immediately terminate agent status for:
- Violation of these terms
- Fraudulent or illegal activity
- Breach of confidentiality
- Failure to meet performance standards after improvement period
10. Intellectual Property
All QuickMarkr trademarks, logos, and proprietary materials remain the exclusive property of QuickMarkr. Agents receive limited license to use approved materials solely for authorized agent activities.
11. Liability and Indemnification
11.1 Limitation of Liability
QuickMarkr's liability to agents is limited to unpaid commissions. We are not responsible for indirect, incidental, or consequential damages.
11.2 Agent Indemnification
Agents agree to indemnify QuickMarkr against claims arising from their actions, violations of these terms, or client relationships managed by the agent.
12. Dispute Resolution
Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. This agreement is governed by the laws of [Your Jurisdiction].
13. Updates to Terms
QuickMarkr reserves the right to update these terms with 30 days' notice. Continued participation in the agent program constitutes acceptance of updated terms.
